The Legal Process

The legal work is an important part of the adoption process.  In fact, all parties involved in adoption, including you, the baby, and the adoptive parents will have their own attorney.  Attorneys are needed to handle all the legal aspects of adoption and make sure it is done right.  If you do not already have an attorney to represent you, our agency will make sure that you have a private attorney, who is experienced in handling adoptions.  Our agency works with law offices across the state.

The attorney will contact you, fully explain the legal part of adoption, and represent you in court.  Your attorney will talk with you and let you know how adoption law relates to your particular situation.  The attorney will answer your legal questions related to adoption and complete all the necessary legal paperwork.

Once the legal documents are filed with the court, a court date is set to terminate parental rights.  There are a number of factors that affect when the court date is set.  Your attorney will explain those to you.  When parental rights are terminated, the decision cannot be appealed.  Kentucky law requires birth parents to appear in court. Your counselor and the attorney will attend court with you. The court appearance is usually very brief.
